Electronic Evidence Tools to Expedite Criminal Proceedings: MHA

New Delhi, August 5: In a significant step toward enhancing the speed, transparency, and efficiency of India’s judicial process, the Ministry of Home Affairs has rolled out several digital applications and legislative provisions to support the integration of electronic evidence in criminal proceedings.

Key digital tools introduced include e-Sakshya, e-Summon, and Nyaya-Shruti (VC). The e-Sakshya platform enables lawful, scientific, and tamper-proof collection, preservation, and submission of digital evidence, improving the authenticity of evidence and reducing procedural delays. e-Summon facilitates the electronic delivery of summons, ensuring faster and trackable communication. Nyaya-Shruti (VC) enables the virtual appearance of accused individuals, witnesses, police personnel, prosecutors, scientific experts, and prisoners through secure video conferencing channels.

Additionally, integration with the MedLeaPR platform allows seamless exchange of Medico-Legal Examination and Post-mortem Reports between law enforcement and hospitals.

The National Crime Records Bureau (NCRB) has developed 23 new software patches for the Crime and Criminal Tracking Network Systems (CCTNS) in line with the provisions of the new criminal laws. These upgrades have been shared with all states and Union Territories for implementation.

To support legal practitioners and enforcement officers, NCRB has also launched a mobile application titled ‘NCRB Sankalan of Criminal Laws’, a comprehensive guide to the updated criminal statutes. The app is available on both Android and iOS platforms.

Under the Bhartiya Nagarik Suraksha Sanhita (BNSS), 2023, several sections explicitly provide for the use of electronic and audio-video means in judicial processes:

  • Section 254: Electronic recording of evidence for protection.
  • Section 265: Evidence for prosecution.
  • Section 266: Evidence for defence.
  • Section 530: Permits all trials, inquiries, and proceedings to be conducted in electronic mode.

These initiatives are part of a broader push by the Ministry to digitize criminal justice systems and streamline courtroom procedures.
