Tamil Nadu RERA Bans ‘Terms and Conditions Apply’, Travel Time Claims in Real Estate Ads

CHENNAI, July 10:
In a major step toward transparency in the real estate sector, the Tamil Nadu Real Estate Regulatory Authority (TNRERA) has banned vague disclaimers such as ‘terms and conditions apply’ in all real estate advertisements. The order, dated July 1, also prohibits travel time claims from landmarks to project sites due to their variable nature.

Key Guidelines:

  • Mandatory Information: Every advertisement must clearly mention the builder’s name, office address, contact details, and the exact project location as per the approved plan.

  • Travel Time Ban: Builders cannot mention travel time from landmarks. If they refer to a nearby landmark, only the distance via the commonly used route may be specified.

  • TNRERA Registration Display: All ads—print, digital, or outdoor—must carry the TNRERA registration number, a QR code (Form-C), and the website address of the Authority.

    • These must appear on the top right corner in a minimum 12-point font size.

Scope of Enforcement:

  • Applies to newspapers, magazines, brochures, flyers, and web/social media ads (Facebook, Instagram, LinkedIn, etc.).

  • Outdoor advertising, including hoardings, vehicle wraps, bus shelters, and road dividers, must also comply with the new rules.

Legal experts say these measures are essential to protect homebuyers from misleading claims and ambiguous promises.

“Such regulations are critical. A developer misrepresenting project details through ads, brochures, or sale agreements can now be held legally accountable,” said Advocate Chandrachud Bhattacharyya.

He emphasized that homebuyers deserve clarity, transparency, and legal protection when investing in a home—often a once-in-a-lifetime purchase.
